In the following 4 sections, we will inform you in a general manner about the personal data we process, our processing purposes and duration, the legal basis for processing and eventual disclosures to third parties.

Personal data processed (data categories)

We use personal data that you provide to us, that we collect about you or that we have received from third parties. The most important are:

  • Contact and identification data, such as name, surname, e-mail-address, mailing address, phone number, copy and number of the official identity card/passport, user account information
  • Professional qualifications that also relate to the position/function in the company or organization
  • Customer history including customer segment and target group information
  • Financial data, such as account and payment information
  • Contractual data, such as type of contract, content of the contract, type of products and/or services purchased, project references, calendar entries
  • Communication data, such as electronic or written correspondence with us, telephone or video calls, social media posts
  • Interaction, usage and other technical data such as IP address, cookie information, browser settings, frequency of website visits, preferred language, consents, device settings, operating system, information from assertion of rights.

In addition to the data that you provide us with directly, there are also types of data that we receive about you from third parties, in particular in connection with the use or provision of services (e.g. contact data, professional qualifications, financial data, correspondence).

Insofar as it is permitted, we also obtain certain data from publicly accessible sources (e.g. debt collection registers, commercial registers, media, internet) or from authorities and other third parties such as credit reference agencies.

 

General Purposes and duration of processing

We process personal data primarily to fulfill our (pre-)contractual as well as legal obligations. We also rely on the processing of personal data for the purchase of products and services from our suppliers and subcontractors. If you work for a customer or business partner, your personal data may of course also be affected in this capacity.

Furthermore, we use the data we collect, in order to maintain our relationship with our customers and prospects,  e.g. in order to create our newsletter “The Webrepublican”, develop our website and adapt it to new requirements, and in order to provide you with relevant information and services and as well as for internal statistical purposes.

We process personal data as long as it is necessary for the fulfillment of our contractual and legal obligations or otherwise for the purposes pursued with the processing, for example, for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) and beyond that in accordance with the statutory retention and documentation obligations. In this context, it is possible that personal data will be retained for the time during which claims can be asserted against our company and insofar as we are otherwise legally obligated to do so, or legitimate business interests require this (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the purpose for which it was collected, it will be deleted or anonymized.

 

Legal basis of the processing

Insofar as you have given us consent to process your personal data for certain purposes, we process your personal data within the scope of and based on this consent, insofar as we have no other legal basis and we require such a basis. Consent given can be revoked at any time, but this has no effect on data processing that has already taken place. You can send us a revocation by e-mail or by post to the (e-mail) address mentioned above. You can independently revoke consent in connection with cookies and other tracking technologies by (re)opening our cookie consent banner and making the appropriate settings.

We also regularly use the following as a legal basis for processing your personal data:

  • the conclusion or performance of a contract with you or your request in advance of this
  • a balancing of interests/legitimate interest (for example, when personal data is provided to us on a registration form for interested parties)
  • a legal obligation (for example, for us to store accounting-related documents)

 

Disclosure to third Parties 

Within the scope of our business activities, we also disclose all the mentioned data categories to third parties, as far as this is permitted and appears to us to be appropriate, either because they process it for us or because they want to use it for their own purposes. In particular, this concerns mainly our (pre-)contractual and legal obligations and the following entities (all joint recipients):

  • service providers of ours (as well as external ones, such as banks, insurance companies), including sub-processors
  • IT service providers(e.g. Web hosting providers, operators of our CRM, operators of our ERP, operators of collaboration/document management tools)
  • payment service providers
  • distributors, suppliers, subcontractors and other business partners
  • customers
  • domestic and foreign authorities, official agencies or courts
  • further Webrepublic companies
  • the media
  • the public, including visitors of the website and social media
  • competitors, industry bodies, associations, organizations and other bodies
  • other parties in potential or actual legal proceedings
  • purchasers or parties interested in purchasing business units or companies from Webrepublic

These recipients are partly domestic but may be anywhere in the world. You should expect your data to be transferred to all countries where the service providers we use are located.If data could be transferred to a country that does not have an adequate level of data protection, we require that the recipient take appropriate measures to protect personal data, e.g. by means of the Transatlantic EU-US or Swiss-US Data Privacy Framework or the agreement of so-called EU standard contractual clauses. Further information and a copy of the EU standard contractual clauses can be found here. Please note that such contractual precautions partially compensate for weaker or absent legal protection, but cannot completely exclude all risks (e.g. of state access abroad). In certain cases, we may also transfer data in accordance with data protection regulations without such contracts, e.g. if you have consented to the corresponding disclosure or if the disclosure is necessary for the execution of the contract, for the establishment, exercise or enforcement of legal claims or for overriding public interests.

 

Specific purposes of processing

We primarily use collected data in order to conclude and process contracts with our customers and business partners, in particular in connection with our online marketing services to our customers and the procurement of products and services from our suppliers and subcontractors, as well as in order to comply with our domestic and foreign legal obligations. You may be affected by our data processing in your capacity as an employee of such a customer or business partner.

In addition, in line with applicable law and where appropriate, we may process your personal data and personal data of third parties for the following purposes, which are in our (or, as the case may be, any third parties’) legitimate interest, such as:

  • providing and developing our products, services and website, apps and other platforms,

    on which we are active

  • communication with third parties and processing of their requests (e.g., job applications, media inquiries)

  • prevention and investigation of criminal offences and other misconduct (e.g. conducting internal investigations, data analysis to combat fraud)
  • ensuring our operation, including our IT, our website, apps and other appliances
  • video surveillance to protect our domiciliary rights and other measures to ensure the safety of our premises and facilities as well as protection of our employees and other individuals and assets owner by or entrusted to us (such as e.g. access controls, visitor logs, network and mail scanners, telephone recordings)
  • measures for business management and compliance with legal and regulatory obligations as well as internal regulations of Webrepublic

 

Visiting our Website

When you visit our website and view pages or content, you leave behind information on the nature of your visit, such as your choice of pages (URL), the date and time of your visit, the IP address of the requesting device, information on your device type and operating system and your browser ID (user agent string). In addition, the following data can be stored: country from which our website is accessed, information about your internet access provider, Time zone difference to Greenwich Mean Time (GMT), Content of the request (specific page), Access status/HTTP status code and the amount of data transferred.

The purpose of processing this information is to display our website and its content and offers correctly and to ensure data traffic, to optimize our website, content and offers, to ensure the stability and security of our website and systems on a permanent basis, and to enable the clarification, defense and prosecution of cyber-attacks, spam and other unlawful acts in relation to our website and systems and to enforce claims in this regard.

We delete your personal data as soon as they are no longer required to achieve the purpose for which they were collected. In the case of the collection of data for the provision of our website, the deletion takes place when the respective session has ended.

For the hosting of the website, we may use services of third parties in Switzerland and abroad, which carry out the above processing on our behalf. Currently, our website is hosted exclusively by Swiss hosting providers and on servers in Switzerland.

 

Contact us

Our website offers you the possibility to contact us via a contact form and/or by e-mail. If you send us inquiries via contact form, the information you provide in the form, including the contact data you enter there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions and will not be disclosed to third parties without your consent.

Some of our forms may have been created with HubSpot Forms, a service of HubSpot Inc. based in the USA. It cannot be ruled out that certain data may be processed in countries that do not have an adequate level of data protection. To protect your data, we have concluded a data processing agreement with HubSpot. In it, HubSpot promises to ensure an adequate level of data protection by relying on the EU standard contractual clauses. HubSpot is also certified under the EU-U.S. and Swiss U.S. Data Privacy Framework. For more information on data processing by HubSpot, please refer to their privacy policy.

Your personal data will be deleted as soon as your request has been dealt with. This is the case if the circumstances indicate that the matter in question has been conclusively clarified and the deletion does not conflict with any legal obligations to retain data.

 

Newsletter 

To subscribe to our newsletter it is necessary to provide a valid e-mail address. We need this information to send you our newsletter. If we ask you for further information, such as your first or last name, you enable us to send you even more targeted information.

Subscription to our newsletter takes place in a so-called double opt-in procedure. This means that after registration and clicking the appropriate checkbox (e.g. subscribe) you will receive an e-mail in which you must click a link to confirm your registration. If you do not confirm your email address, you will not receive our newsletter.

Our newsletters may contain, in part and to the extent permitted, graphics and/or web links that record on a personal basis whether, when and how often an individual newsletter was opened in an e-mail application and which web links were clicked on. Such graphics and/or web links record the use of newsletters to ensure quality and to enable improvements to the newsletter. You can block the setting of such graphics and/or web links in your e-mail application.

For this purpose and to deliver our newsletter to you, we use HubSpot Inc. based in the USA (“HubSpot”). HubSpot is a service with which, among other things, the sending of newsletters can be organized and analyzed. The data entered for the purpose of receiving newsletters is transferred to HubSpot’s servers and stored there. According to HubSpot, data may be transferred and processed worldwide, in particular to the USA and other countries in which HubSpot, its subsidiaries or its sub-processors operate as data processors.

To protect your data, we have entered into a Data Processing Agreement with HubSpot. In it, HubSpot promises to ensure an adequate level of data protection by applying the EU standard contractual clauses. HubSpot is also certified under the EU-U.S. and Swiss U.S. Data Privacy Framework

You can revoke your consent to the storage of your data and its use for sending the newsletter at any time and free of charge, for example via the “unsubscribe” link in the newsletter or by sending an e-mail to the e-mail address mentioned above (“Contact”).

Starting a career at Webrepublic

If one of our job offers appealed to you and you would like to become part of the team at one of Europe’s leading digital agencies, please feel free to apply. When you apply for a job with us, we process personal data that we receive from you as part of the application process respectively that you enter or upload in the application form. In addition to your Contact and identification data and other personal details, education, work experience and skills, this includes the usual correspondence data such as e-mail address and telephone number. In addition, all documents submitted by you in connection with the application, such as your CV and references, will be processed. When processing job applications, we often need to take notes in order to check your suitability for the position (or possibly other open positions in our company) and to carry out the application process (together with the other data and documents already mentioned). Data may also be processed for statistical purposes (e.g. reporting). However, we ensure that no conclusions can be drawn about individual persons.

We process the data in our applicant management system Softgarden, an online service provided by softgarden e-recruiting GmbH, in Germany. As an applicant, you can use Softgarden to send us a digital application. According to Softgarden, the data provided for registration is then stored exclusively on servers in Germany. Further details can be found in Softgarden’s privacy policy.

You will receive an automatic confirmation email when we receive your application in the job applicant portal.

If you provide references in your application, we assume that you have obtained their consent for this data processing.

If the application process leads to employment, your data will be transferred to the personnel master and personnel file as part of the employment relationship.

If the application process does not lead to a job offer, we will delete the documents you submitted in the event of a rejection after 6 months at the latest , provided that we do not have to process your data further to fulfill legal obligations or to defend or assert legal claims

 

Cookies and similar technologies

Our website uses so-called cookies. Cookies are small text files that are stored on your end device (laptop, tablet, smartphone or similar) automatically with the help of the browser. They contain a unique identification number (an ID) and serve to make our website more user-friendly and effective overall and to make your visit to our website as pleasant as possible. Cookies allow us to distinguish individual visitors from others, but usually without identifying them. Depending on the purpose, cookies contain further information, e.g. about pages accessed and the duration of a visit to a page.

Analysis tools / digital marketing

We use modern, advanced analysis methods and tools to understand users’ habits on our website. This information helps us improve our products and services and provide relevant services and information. In principle, we use only anonymized data that does not allow us to identify the user.

Below we describe the analysis services and technology that we use for such purposes. Additionally, we show how you can prevent these services from analysis of your use of our website. The services we use on our website may use cookies, tags and pixels. We have already explained what cookies are above. Tags are small sections of code built into websites and mobile applications that notify a server when a user carries out a certain action (e.g. clicking on a button). Pixel tags (also known as web beacons) are tiny image files embedded in websites or emails that allow conclusions to be drawn.

 

Consent Management Platform

We use the Usercentrics Consent Management Platform from Usercentrics GmbH, based in Germany, as a consent management tool for the analytics and online marketing activities on our website. When cookies are mentioned later in this data protection declaration, these are cookies that can be controlled via the Consent Mangement Platform.

The Usercentrics Consent Management Platform collects log file and consent data using JavaScript.

This JavaScript makes it possible to inform the user about his consent to certain tags on our website and to obtain, manage and document this consent. We process the following data: Consent data (e.g. consent ID, consent number, timestamp of consent, opt-in or opt-out data, banner language, customer setting, template version) and device information (e.g. HTTP agent, HTTP referrer), IP address, geolocation data. The ConsentID (contains the above data), the consent status including time stamp are stored in your browser’s local memory and simultaneously on the cloud servers used.

According to Usercentrics, the data processed within the framework of the Consent Management Platform is stored on servers in the EU.

To the extent that we ask for your consent for the use of cookies, you can revoke such consent at any time with effect for the future. You can do this independently by reopening Consent Management Platform and adjusting your settings accordingly.

 

Google Services

On our website, we use various services of Google LLC, based in the USA, or if you have your habitual residence in the European Economic Area (EEA) or Switzerland, Google Ireland Ltd, based in Ireland (“Google”). Google LLC is always responsible for the processing of personal data when using Google Maps”. We use the following Google services on our website:

Google uses technologies such as cookies, web storage in the browser and tracking pixels, which enable an analysis of your use of our website. The information thus generated about your use of our website may be transmitted to a Google server in the USA or other countries and stored there. Information about the locations of Google’s data centers can be found here.

We use tools provided by Google that Google claims can process personal data in countries where Google or its subprocessors maintain facilities. Google promises in its “Data Processing Addendum for Products where Google is a Data Processor” to ensure an adequate level of data protection by relying on the EU standard contractual clauses and (Google LLC) being certified under the EU-U.S. and Swiss U.S. Data Privacy Framework.

You have the option of refusing interest-based advertising by Google. To do this, you must make the appropriate settings for personalized advertising on all browsers you use.

 

Google Tag Manager

Our website uses Google Tag Manager. With Google Tag Manager, website tags can be managed efficiently. Website tags are placeholders that are stored in the source code of the respective website, e.g. to record the integration of frequently used website elements, such as code for web analytics services.

The Google Tag Manager is an auxiliary service and processes personal data itself only for technical purposes (e.g., to correct any connection errors) and provides for the triggering of other tags, which in turn may collect data. Google Tag Manager does not have access to this data. If a deactivation has been made at the domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.

Google Analytics 4

For the purpose of analyzing our website and its visitors, as well as for marketing and advertising purposes, we use the web analytics service Google Analytics 4.

Google Analytics uses cookies that are stored on your terminal device (laptop, tablet, smartphone, etc.) and enable an analysis of your use of our website. This allows us to evaluate the usage behavior on our website and to design our offer in a more interesting way via the statistics/reports obtained.

We use Google Signals. This allows Google Analytics to collect additional information about users who have activated personalized ads (interests and demographics), and ads can be delivered to these users in cross-device remarketing campaigns.

Google Analytics 4 has IP address anonymization enabled by default. This means that your IP address is shortened by Google within Switzerland or the EU/EEA before it is transmitted. Only in exceptional cases is the full IP address transmitted to a Google server and shortened there.

Google uses this information to evaluate your [pseudonymous] use of our website, to compile reports on website activity and to provide us with other services related to website activity and internet usage. When you visit our website, your user behavior is recorded in the form of events (such as page views, interaction with the website or your “click path”) as well as other data such as your approximate location (country and city), technical information about your browser and the end devices you use or the referrer URL, i.e. via which website / advertising material you came to our website.

The data collected by means of Google Analytics is automatically deleted after 14 months.

If you are logged into your Google account and surf on our webpage, Google may, under certain circumstances, be able to draw conclusions about the identity of the visitors to the website based on the collected data and therefore create personal profiles and link the obtained data to your Google account.

You can prevent the collection and transmission of the data generated by the cookie and therewith related to your use of our website (including your IP address) to Google and the processing of this data by Google by downloading and installing the . If you wish to object to interest-based advertising by Google, you can not give your consent for statistics in the consent management platform or use the provided by Google. If consent for cookies to be stored has not been granted, tags send so-called pings to Google for behavioral and conversion modeling to measure the effectiveness of our online marketing activities. The models use characteristics such as browser type, type of conversion action, time of day and other general, non-identifying variables. Google Floodlight

We use Google’s Floodlight tag to measure the effectiveness of our advertising campaigns, to limit the number of times you see a particular ad, and to display only ads that are relevant to you and your interests. In particular, information about the advertisements you have clicked on and your previous user behavior on third-party websites is collected and stored. Google uses a cookie ID to record which ads are displayed in which browser and to prevent them from being displayed multiple times. In addition, Google can use cookie IDs to record so-called conversions that are related to ad requests. This is the case, for example, when a user sees a Google Ad and later visits our website with the same browser and buys something there. The cookies do not contain any personal information such as email addresses, names or addresses.

Based on the marketing tools used, your browser automatically establishes a direct connection with the Google server. Through the integration of the Floodlight tag, Google receives the information that you have accessed the corresponding part of our website or clicked on one of our ads.

In addition, the Floodlight tags used enable us to understand whether you perform certain actions on our website after you have viewed one of our display/video ads on another platform or clicked on it (conversion tracking). Google uses this cookie to understand the content you have interacted with on our websites and to be able to send you targeted advertising later.

 

Google Ads

We use Google Ads, an online advertising program from Google. Google Ads uses cookies to analyze the use of our website. A cookie is set if you have reached our website via a Google ad. Cookies of this type have a limited validity, do not contain personal data and are therefore not used for personal identification. If you visit certain pages of ours and the cookie has not yet expired, we and Google can recognize that someone has clicked on the ad and thus been redirected to our website.

We use a tool called conversion tracking as part of Google Ads. When you click on an ad placed by Google, a conversion tracking cookie is set. The information obtained using the conversion cookie is used to generate conversion statistics. We learn the total number of users who clicked on an ad and were redirected to a page with a conversion tracking tag. However, we do not receive any information that could be used to personally identify users.

We also use the remarketing function of Google Ads. This enables us to display interest-based advertising to visitors to our website on other websites within the Google advertising network, such as YouTube or Google ads. For this purpose, the interactions of our website visitors are analyzed (e.g., which products they were interested in), so that we can show them targeted advertising on other websites even after they have left our website. To make this possible, Google sets cookies when they visit certain Google services or websites within the Google advertising network. The cookies are used to uniquely identify the browser used and not to identify a person.

Google Marketing Platform

The online marketing tool Google Marketing Platform (“GMP”) uses cookies to serve ads that are relevant to users, to improve campaign performance reports, or to prevent a user from seeing the same ads more than once. Using a Cookie ID, Google records which ads are served in which browser and can thus prevent them from being displayed more than once.

In addition, GMP can use cookie IDs to record so-called conversions, i.e. whether a user sees a GMP ad and later calls up the advertiser’s website and makes a purchase there. According to Google, GMP cookies do not contain any personal information.

Your browser automatically establishes a direct connection with Google’s server. We have no influence on the scope and further use of the data collected by Google through the use of this service. According to Google, by integrating GMP, Google receives the information that you have called up the relevant part of our websites or clicked on an advertisement from us. If you are registered with a Google service, Google can assign the visit to your user account. Even if you are not registered with Google or have not logged in, there is a possibility that the provider may obtain and store your IP address.

Google Maps

To integrate interactive maps on our website, we use the online map service Google Maps.

When visiting a website on which Google Maps is embedded, Google Maps will set a cookie. This cookie is usually not deleted by closing the browser, but expires after a certain time, unless you delete it manually beforehand.

By using Google Maps, information about your use of our website (including your IP address) may be transmitted to a Google server in the USA and stored there. Google may store this data as usage profiles for the purpose of tailoring its services, advertising and market research. If you are logged in to Google, your data will be directly assigned to your account. If you do not wish this, you must log out beforehand.

If you do not agree with this processing of your information, you have the option to deactivate the Google Maps service. To do this, you must deactivate the Java Script function in your browser. However, this may also affect other functions of our website.

Google Fonts

This website uses external fonts, Google Fonts. This informs the server which of our websites you have visited. The IP address of the browser of the visitor’s end device to this website is also stored by Google. YouTube

When you start playing a YouTube video on our website, a connection to the YouTube servers is established. This lets the YouTube server know, which of our websites you have visited. This information (including your IP address) may be transmitted to a Google server in the USA and stored there. If you are logged into your YouTube account at the same time, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account before visiting our website.

We use the so-called privacy-enhanced mode of YouTube. According to YouTube, this mode ensures that YouTube does not store any data about you as a visitor to our website before you watch or play the video. However, the transfer of data to YouTube partners is not necessarily excluded by the privacy-enhanced mode.

reCAPTCHA 

The reCAPTCHA function is used to distinguish whether an entry (e.g. in a contact form) is made by a human or automatically by a computer program (so-called bots). In this way, we want to ensure the security of our website and protect them in particular from automated entries (or attacks) and from spam. The processing is thus based on our legitimate interests.

For this purpose, reCAPTCHA analyzes the behavior of the website visitor on the basis of various characteristics. These analyses run completely in the background and begin automatically as soon as you visit our websites. To differentiate between humans and bots, Google analyzes various information, such as the IP address of the end device used, time spent on the website, the browser and operating system used or mouse movements made by the website visitor.

Meta Pixel, Custom Audiences and Facebook Conversions

Our website uses Meta Pixel, if you are habitually resident in the European Economic Area (EEA) or Switzerland, a service provided by Meta Platforms Ireland Ltd, based in Ireland. The parent company is Meta Platforms Inc., based in the USA (“Meta”). Instagram is also a service of Meta. Meta promises to ensure an adequate level of data protection by relying on the EU standard contractual clauses and being certified under the EU-U.S. and Swiss U.S. Data Privacy Framework.

With the help of the Meta pixel, it is possible for Meta to determine the visitors to our online offers as a target group for the display of ads (so-called “Facebook Ads” or “Instagram Ads”). Accordingly, we use the Meta Pixel to display the Facebook and Instagram Ads placed by us only to those Facebook or Instagram users who have also shown an interest in our online offers or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Meta (so-called “Custom Audiences”). With the help of the Meta pixel, we also want to ensure that our Facebook and Instagram ads correspond to the potential interest of users and do not have a harassing effect. With the help of the Meta pixel, we can also track the effectiveness of the Facebook and Instagram ads for statistical and market research purposes by seeing whether users are redirected to our website after clicking on a Facebook or Instagram ad (so-called “conversions”).

Furthermore, we use the additional function “Automatic Advanced Matching” when using the Meta pixel. Here, data such as telephone numbers, e-mail addresses, dates of birth or postal codes are sent to Meta in encrypted form as additional information, provided that you have made this data available to us. This enables us to increase the number of assigned “conversions” and to enlarge our “Custom Audiences”. We also use the “Custom Audiences from File” procedure. This allows us to upload various customer information, such as email addresses, phone numbers, first and last names, to Meta in encrypted form. Using this information, Meta can determine whether someone on Facebook or Instagram should be added to our advertising target group. This is to ensure that ads are only shown to users who have an interest in our information and services. Data processing by Facebook takes place within the scope of Meta’s privacy policy. You can find general information on the display of Facebook and Instagram Ads in this policy.

Through the use of cookies, Meta can subsequently recognize you in the member area of Facebook or Instagram and optimize the efficiency of advertisements, e.g. by offering advertisements targeted to specific groups. The prerequisite for this is that you have a Facebook and/or Instagram account and are logged into the member area of Facebook or Instagram. If you are not a member of Facebook or Instagram, you are not affected by this data processing.

LMS stores and processes information about your user behavior on our website. For this purpose, LMS uses, among other things, cookies that are stored locally in the cache of your web browser on the respective end device used by you and enable an analysis of your use of our websites.

We use LMS for marketing and optimization purposes, in particular to analyze the use of our websites, to continuously improve individual functions and offers as well as the user experience and to place relevant and interesting ads for you. In particular, we use the LinkedIn Insight tag, which allows us to track conversions, retarget our website visitors, and gain additional information about the LinkedIn members who view our ads. To do this, LinkedIn uses a JavaScript code (Insight tag), which in turn stores a cookie in your web browser or uses a pixel.

The data collected via the LinkedIn Insight tag is encrypted, IP addresses are truncated and members’ direct IDs are removed within seven days to pseudonymize the data. This remaining pseudonymized data is deleted within 90 days. On our website, we have set up links to our social media presence on Facebook, Instagram, LinkedIn, X and YouTube.
